General terms and conditions
§ 1 Scope of application
(1)
The business relationship between TN Fashion and the purchaser of goods via the online sales platform from the Internet address www.alpin-lodge.fashion (Alpin Lodge Online Shop) shall be governed exclusively by the following General Terms and Conditions (GTC). Alpin Lodge is a registered trademark of TN Fashion.
(2)
Goods as defined by the GTC are all products and services that can be purchased as part of an online order in the Alpin Lodge online store.
§ 2 Conclusion of contract
(1)
The presentation of goods in the Alpin Lodge online store does not constitute a binding offer to conclude a purchase contract.
(2)
Only persons of legal age may place orders. Goods are only sold in normal household quantities.
(3)
With your order – by clicking the button “Order with obligation to pay” – you enter a binding intention to purchase. TN Fashion will send an automatic confirmation of receipt of the order by e-mail, documenting the order. This automatic confirmation merely confirms that your order has been received by TN Fashion and does not constitute acceptance of your order.
(4)
Depending on the chosen means of payment, TN Fashion reserves the right to check your details with regard to the means of payment, its validity, your creditworthiness with regard to the order value and, depending on the result of the check, to refuse to accept orders.
(5)
The contract with TN Fashion is only deemed valid when TN Fashion issues a separate e-mail confirming that goods have been dispatched to you. The acceptance period is a maximum of 7 calendar days.
(6)
If delivery of the goods ordered by you is not possible, for example because the goods in question are not in stock, TN Fashion will not issur a declaration of acceptance. In this case, a contract is validated. We will inform you of this immediately and refund any payments already received without delay.
(7)
The language of contract and all contractual correspondence is German.
(8)
Your order data will be stored by us in accordance with statutory regulations. If you are registered in the online store, you can access your order data under “My account”.
If you lose your order documents, please contact us by e-mail or telephone at info@alpin-lodge.fashion or on +49 (0)151/26 19 75 91. We will be happy to send you a copy of your order as saved in our system.
§3 Right to revoke and agreement to bear costs

If you are a consumer, you are entitled to the following right to revoke when making a purchase in the Alpin Lodge online store:

Right of withdrawal
You have the right to cancel this contract within fourteen days without giving reasons. The period of revocation is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
Sample withdrawal form
If you wish to revoke the contract, you can inform us of your decision to revoke from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). You can formulate the revocation yourself or use the sample revocation form, though this is not mandatory.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of supplementary costs as a result of choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Repayment will be made via the same means of payment that was used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until we have the goods have been returned or until you have provided proof that you have returned the goods, whichever is the earliest.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
(3)
The right of withdrawal does not apply to distance contracts
(a) for the delivery of goods which are manufactured according to customer specifications or which are clearly tailored to the personal needs of the customer or which are not suitable for return due to their nature,
(b) for the delivery of audio or video recordings or software if you have broken the seal on the delivered data carriers.
(4)
We reserve the right, at our sole discretion, to refuse to accept the return of goods if
– you do not return the goods to us including all components (e.g. product packaging, such as protective bags for shoes, belts, bags, high-quality shoe boxes, etc.),
– the goods are not in their original condition (e.g. if security or other labels have been removed from the goods),
– the goods show signs of wear.
If we nevertheless accept the returned goods, we are entitled to demand appropriate compensation from you and to offset this against any purchase price already paid.
§ 4 Retention of title
The goods remain the property of TN Fashion until they have been paid for in full.
§ 5 Delivery
Unless other delivery times have been agreed, the delivery time is up to 10 working days from receipt of the order, unless shorter times are specified in the order process.
§ 6 Prices / Shipping costs

§ 7 Terms of payment, means of payment

You can pay with certain credit cards and PayPal.

The time of payment/debit varies depending on the means of payment:
Payment by credit card: your credit card will be charged when you complete your order.
Payment by PayPal: Your PayPal account will be debited when the order is completed.

Unless otherwise agreed, payment of the purchase price is due immediately upon conclusion of the contract. In the event of late payment, TN Fashion is entitled to charge interest on arrears at a rate of 5 percentage points above the base interest rate announced by the European Central Bank per annum. If TN Fashion has demonstrably incurred higher damages due to default, TN Fashion is entitled to claim these.
§ 8 Warranty
TN Fashion is liable for material defects and defects of title in accordance with the applicable statutory provisions, in particular §§ 434 ff. BGB. The limitation period is two years in accordance with § 438 para. 1 no. 3 BGB and begins with the delivery of the goods.
A restriction of your right of revocation in accordance with § 3 is not associated with the above provisions in paragraphs 1 – 4.
§ 9 Dispute resolution
Online dispute resolution pursuant to Art. 14 para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/.
TN Fashion will not participate in dispute resolution proceedings at a consumer arbitration board.
§ 10 Copyrights
The content and structure of the Alpin Lodge online store and the other websites operated by TN Fashion are protected by copyright. All texts, images, graphics, sound, video and animation files are subject to copyright, trademark law and other laws for the protection of intellectual property. Some Internet pages also contain images, graphics, sound, video and animation files that are subject to copyright, trademark law and other laws for the protection of intellectual property of those who have made them available. Copying or other use for purposes other than private use or for forwarding, other publication, reproduction and distribution, whether in original or modified form and in any medium, or such use on other websites is not permitted without prior express written consent of TN Fashion.
§ 11 Data protection and credit assessment

In connection with the statutory right of revocation, TN Fashion collects and stores data on returned goods. In order to avoid excessive returns, TN Fashion evaluates this data up to 12 months backdated and contacts customers with high return rates with the aim of finding a mutually satisfactory solution.
You can cancel the use and processing of your data for our own advertising and marketing purposes and for our own market research at any time by notifying

(2) Credit check
As long as the payment method “purchase on account” is not offered or used, we do not carry out a credit check. However, a credit check may be carried out by payment service providers such as PayPal etc.
§ 12 Final provision
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
